Client Agreement

Thank you for choosing Brides & Baches for your weekend in the desert! We're committed to delivering an unforgettable experience for you and your party. By selecting the "Terms and Conditions" checkbox during checkout, you acknowledge and accept all terms stated in this Client Agreement and assume full responsibility for your entire party.

This Agreement incorporates by reference the Brides & Baches Refund, Cancellation & Return Policy, which forms part of these terms. By agreeing to this Agreement, you also agree to the Refund, Cancellation & Return Policy in full.

I. Services Purchased

Brides & Baches will provide the services specified in the invoice(s) at the designated date and time. Bookings are considered final upon receipt of full payment or applicable deposit and proper execution of this Agreement. All invoices are incorporated into this Agreement. In the event of a conflict between an invoice and this Agreement, the terms of this Agreement shall prevail.


II. Method of Payment & Deposit Program

All payments shall be made in US Dollars through the Brides & Baches invoice payment system or any alternative method mutually agreed upon in writing.

Deposit Program

  1. Eligibility: The deposit program is available for select packages (currently Boujee B and Better Than Basic B). Mini and Hotel packages are not eligible.
  2. How It Works: After selecting your package, theme, and add-ons, request the deposit option when contacting us. We will issue an invoice for 25% of your total package cost. Payment is due within 48 hours of the invoice date to secure your booking.
  3. Balance & Final Invoice: The remaining 75% is due 40 days before your event. A final invoice will be sent at that time and must be paid within 10 days.
  4. Non-Refundable: The 25% deposit is non-refundable under all circumstances and is applied toward the total package cost.

III. Service Area

Brides & Baches operates within a designated service area bounded by Highway 51 (Piestewa) to the West, Loop 101 (Pima) to the East, Loop 202 (Red Mountain) to the South, and Loop 101 (Pima) to the North. If the client's location is outside this area, or if the location changes after being communicated to us, an additional travel fee will apply — a minimum of $50 for up to 10 miles past the service area boundary, and $150 for up to 25 miles. We will notify the client within 24 business hours of receiving the final location regarding any additional fees or setup time adjustments.

IV. Arrival Time & Setup

We aim to arrive at or before the time indicated on your invoice. In the unlikely event of a delay, we will notify you by text or call with an estimated arrival time. Decoration setup typically takes up to 2 hours to complete. Brides & Baches will make reasonable efforts to complete setup within the confirmed setup window; however, setup timing may be affected by factors outside our control, including property access limitations, building rules, or safety considerations.


V. Integrity of Decorations

Brides & Baches uses high-quality materials and strives to create an amazing experience for your party. However, over the duration of your stay and due to weather or environmental conditions, decorations may fall, deflate, or deteriorate in quality. This does not constitute a service failure.


VI. Packages Sent on Behalf of Client

Brides & Baches assumes no responsibility for items you order and ship to us, including shipment delays, damaged items, or missing packages. We will receive packages on your behalf but are not liable for any issues arising from the shipping process.

Perishable items should not be shipped to Brides & Baches. The client is responsible for ensuring no perishable items are included. We will not be liable for damage, spoilage, or loss of perishable items unless mutually agreed upon in writing in advance.


VII. Premium Thank-You Gifts

Some premium packages include a thank-you gift curated by or selected with Brides & Baches. The client acknowledges full responsibility for the use of any gift items and compliance with applicable laws. If a gift includes alcohol, the client is solely responsible for ensuring compliance with age restrictions (21+ in the U.S.) and for any liabilities arising from its provision or consumption.

By agreeing to this Agreement, you release Brides & Baches from any liability related to the use or consumption of any thank-you gift. For packages that include alcohol, a copy of your photo ID (front and back) must be emailed to [email protected] before services begin.


VIII. Cancellation & Refunds

All cancellation, rescheduling, and refund requests must be submitted in writing by email to [email protected]. Verbal or text-based cancellation requests will not be accepted as official notice.

How deposits apply: Any deposit already paid will be applied toward the applicable cancellation fee. If the deposit does not cover the full cancellation fee, the remaining balance will still be due.

More Than 7 Days Before the Event

A cancellation fee equal to 50% of the total booking cost will apply. Any deposit paid will be applied toward this fee and the remaining balance of the cancellation fee will still be due.

Within 7 Days of the Event

A cancellation fee equal to 75% of the total booking cost will apply. Any deposit paid will be applied toward this fee and the remaining balance of the cancellation fee will still be due.

Within 48 Hours of the Event

100% of the total booking cost will be due. Cancellations within 48 hours of the scheduled event — including same-day cancellations — are non-refundable. By this point, staffing is committed, décor is pulled, and we are unable to accept another booking in your place.

Rescheduling

Rescheduling requests must be submitted in writing by email and are subject to availability. A new date is not guaranteed. If the requested new date is unavailable, the original cancellation policy will apply and deposits will remain non-refundable. Reschedules requested within 24 hours of the scheduled setup time may incur additional administrative or scheduling fees.

No-Refund Situations

No refunds will be issued, and additional fees may apply, if:

  • The service has been partially used or completed.
  • The client misses their booking without providing written notice at least 48 hours in advance.
  • The booking becomes invalid on the event day due to incomplete agreements, missing required documents, or incorrect or falsified booking information.

IX. Breakdown & Cleanup

Brides & Baches will break down decorations on the morning of the client's departure between 7:00 am and 11:00 am. In exceptional circumstances, breakdown may occur as early as 6:00 am or on the evening prior to the departure date. The client is asked to:

  • Remove pool floats from the pool area and allow them to dry before our arrival.
  • Return reusable items such as table confetti, unused straws, napkins, and other applicable décor items to minimize waste.

X. Missing or Damaged Items

The client is financially responsible for replacing any missing or damaged rental items listed on the invoice, or for paying the replacement cost of such items. The client and their guests are strongly advised to handle all rental items with care. The client accepts responsibility for the conduct of their guests and for any property damage caused during the event.


XI. Substitutions

In rare circumstances, Brides & Baches may need to substitute certain décor elements due to unavailability. The client will be informed in advance of any substitutions and their approval will be obtained before proceeding.


XII. Third-Party Service Providers

Brides & Baches may provide referrals to or make bookings with third-party service providers (such as private chefs, entertainment, or rental properties) on behalf of the client. Brides & Baches is not liable for any issues arising from the client's engagement with these third parties. By agreeing to this Agreement, the client releases Brides & Baches and its affiliates, officers, employees, and agents from any claims arising from such referrals. The client assumes all risks associated with third-party rentals that include a pool or spa.


XIII. Event Property Restrictions

Clients are responsible for confirming that their venue, vacation rental, or property permits decorations, third-party event setup services, and related event activities prior to booking. Clients must also ensure that third-party vendors are permitted at their selected property.

Brides & Baches is not responsible for property rules, HOA restrictions, Airbnb or VRBO policies, or any venue limitations that prevent decorations or event services from being completed as planned. If access is denied or setup is restricted on the event day due to property or HOA rules, cancellation fees will still apply in full.


XIV. Property Access & Venue Availability

Clients are responsible for providing accurate property details prior to the scheduled setup time, including the correct address, entry instructions, gate codes, parking instructions, and any required vendor access permissions.

Brides & Baches is not responsible for delays or inability to complete setup caused by property access issues, including but not limited to incorrect access codes, restricted vendor access, host cancellations, unavailable property managers, delayed check-in, or unexpected venue restrictions.

If Brides & Baches staff arrive at the scheduled location and are unable to access the property or begin setup due to such circumstances, the booking will be considered a client-side failure of access and the applicable cancellation fees outlined in this Agreement will still apply in full.

Clients are strongly encouraged to confirm all access details with their property host or venue manager prior to the scheduled setup time.


XV. Photography & Marketing Use

Brides & Baches may photograph or document event setups for portfolio, website, and marketing purposes. Photography will focus on décor and event styling rather than individual guests.

Clients who do not wish to have their event photographed for marketing purposes may request an opt-out in writing by emailing [email protected] prior to the event date.


XVI. Contact During Your Stay

For questions or concerns during your stay, please contact us by text at 480-932-9056. We will make every effort to respond within 8 business hours. For all official requests — including cancellations, rescheduling, and refund requests — written notice by email to [email protected] is required.


XVII. Warranty

The services provided by Brides & Baches are offered on an "as-is" basis without any express, implied, or statutory warranties, including warranties of quality, performance, or fitness for a particular purpose.


XVIII. Limitation of Liability

By using Brides & Baches services, you accept all risks, both foreseeable and unforeseeable, arising from such transactions. Brides & Baches shall not be liable for any incidental, direct, indirect, negligent, exemplary, consequential, statutory, punitive, or special damages, whether based on breach of contract, tort, strict liability, or any other legal theory, even if advised of the possibility of such damages. In no event shall Brides & Baches' total liability to the client exceed the total amount paid by the client for the services giving rise to the claim.


XIX. Health & Safety Compliance

Clients agree to comply with any applicable health, safety, or venue requirements in effect at the time services are performed. Brides & Baches reserves the right to require clients and their groups to adhere to any safety protocols mandated by applicable law or public health authorities. Failure to comply may result in termination of services without refund.


XX. Severability

If any provision of this Agreement is deemed invalid by a court of competent jurisdiction, the remaining provisions shall remain valid and enforceable. The parties direct the court to modify this Agreement to give effect to the parties' intentions to the fullest extent permitted by law.


XXI. Choice of Law

This Agreement shall be governed, interpreted, and enforced in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any arbitration or legal proceeding shall take place in Maricopa County, Arizona.


XXII. Force Majeure

Neither party shall be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, government orders, pandemics, labor disputes, or supply chain disruptions.


XXIII. Client Indemnification

The client agrees to indemnify, defend, and hold harmless Brides & Baches and its affiliates, officers, employees, and agents from and against any third-party claims, liabilities, damages, or expenses (including reasonable attorney's fees) arising out of or relating to the client's negligence, willful misconduct, or breach of this Agreement, including property damage or personal injury not directly caused by Brides & Baches.


XXIV. Dispute Resolution & Arbitration

Any dispute arising out of or relating to this Agreement shall be resolved by final and binding arbitration in Maricopa County, Arizona, under the rules of the American Arbitration Association. Each party waives the right to a jury trial and agrees to bring any claim in their individual capacity only — not as a plaintiff or class member in any class or representative proceeding. The prevailing party in any arbitration shall be entitled to recover reasonable attorney's fees and costs.


XXV. Payment Default

If the client fails to pay any amount when due, Brides & Baches may charge a late fee of 1.5% per month on the outstanding balance, suspend further services until payment is received, or pursue collection of the debt. The client shall be responsible for all costs of collection, including reasonable attorney's fees.


XXVI. Electronic Communications & Privacy

By providing an email address and telephone number, the client consents to receive electronic communications from Brides & Baches, including invoices, confirmations, updates, and marketing messages. Personal data will be processed in accordance with our Privacy Policy.


XXVII. Termination Rights

Brides & Baches may immediately terminate this Agreement and refuse further services if the client breaches any material provision, including failure to pay fees, misrepresentation of information, or unsafe conduct. Upon termination, all unpaid fees become immediately due and payable.
