By selecting the “Terms and Conditions” checkbox during checkout, you acknowledge the Brides and Baches “Client Agreement” and accept all the terms and conditions stated herein. Furthermore, you assume full responsibility and liability for your entire party.
This document, referred to as the “Service Agreement,” establishes the terms and conditions that govern the expectations and obligations of both parties involved. As the Client, it is crucial that you thoroughly review and understand the contents of this agreement as it affects your legal rights.
I. SERVICES PURCHASED A. Brides and Baches hereby undertakes to provide the services specified in the invoice(s) at the designated date and time (“Services”). Please note that bookings will only be considered final upon receipt of full payment and the proper execution of this Service Agreement. All invoices issued are an integral part of this Service Agreement and shall be incorporated herein as if fully expressed. In the unlikely event that an invoice conflicts with any provision outlined in this Service Agreement, the terms of this Service Agreement shall take precedence and govern all matters in question.
II. METHOD OF PAYMENT A. All payments for the Services shall be made in US Dollars through the Brides and Baches invoice payment system or any alternative method mutually agreed upon by Brides and Baches.
III. SERVICE AREA A. Brides and Baches operates within a designated service area (“Service Area”), which includes the area bounded by Highway 51 (Piestewa) to the West, Loop 101 Highway (Pima) to the East, Loop 202 Highway (Red Mountain) to the South, and Loop 101 (Pima) to the North. If the client’s location is found to be outside the designated Service Area or if the location is changed after being communicated to Brides and Baches, an additional minimum travel fee of $175 will apply up to 30 miles and $200 up to 40 miles of service area, and the setup time may need to be adjusted. Brides and Baches will promptly notify the client within 24 business hours of receiving the final location regarding any additional fees or changes to the setup time.
IV. ARRIVAL TIME AND SETUP A. Our aim is to arrive early or promptly at the time indicated on your invoice. In the unlikely event of a delay, we will notify you via text or call with an estimated time of arrival. Decoration setup typically takes up to 2 hours to complete.
V. INTEGRITY OF DECORATIONS A. Brides and Baches strives to provide decorations that create an amazing experience for your party by using high-quality materials. However, over the duration of your stay and weather conditions, decorations may fall, deflate, or deteriorate in quality.
VI. PACKAGES SENT ON BEHALF OF CLIENT
A. Brides and Baches assumes no responsibility for any issues related to items you order and ship to us, including but not limited to shipment delays, damaged items, or missing packages. Brides and Baches will only receive packages and items on behalf of the client and will not be held liable for any issues arising from the shipping process.
B. The client acknowledges and agrees that perishable items should not be shipped to Brides and Baches. It is the client’s responsibility to ensure that no perishable items are included in the packages sent to Brides and Baches. Brides and Baches will not be liable for any damage, spoilage, or loss of perishable items shipped to them, unless otherwise agreed upon in writing. Only in exceptional circumstances and if mutually agreed upon in writing, Brides and Baches may accept perishable items. The client acknowledges that Brides and Baches will not be liable for any conditions that may spoil or damage said items.
VII. ALCOHOLIC BEVERAGES A. Decoration packages may include alcohol. You are solely responsible for ensuring compliance with all laws and regulations regarding the consumption of alcohol, including not serving alcohol to anyone under the age of 21. If you provide alcohol to family, friends, guests, or third parties, you are solely liable for any damages resulting from providing alcohol, including property damage, personal injury, death, disfigurement, or loss of consortium. By agreeing to this Service Agreement, you expressly release Brides and Baches from any liability or claims arising from alcohol consumption during your stay. A copy of your photo ID (front and back) must be emailed to info@bridesandbaches.com before the commencement of Services.
VIII. CANCELLATION AND REFUNDS A. If you cancel the Services more than 7 days before your scheduled setup date, a 50% cancellation fee will apply. The remaining balance, less the cancellation fee, will be refunded through the original payment method used for booking. We will make every effort to accommodate rescheduling to a new date, subject to availability. Additional fees may apply for rescheduled services requested within 24 hours of the reschedule fee notification.
B. If you cancel the Services less than 7 days before your scheduled setup date, a 75% cancellation fee will apply. The remaining balance, less the cancellation fee, will be refunded through the original payment method used for booking. We will make every effort to accommodate rescheduling to a new date, subject to availability. Additional fees may apply for rescheduled services requested within 24 hours of the reschedule fee notification.
C. Refunds will only be processed through the original payment method used for booking. Requests for refunds will not be accepted under the following circumstances:
IX. BREAKDOWN AND CLEANUP A. Brides and Baches will be responsible for breaking down the decorations on the morning of the Client’s departure between the hours of 7 am and 11 am. However, in exceptional circumstances, the breakdown may occur on the evening prior to the departure date. The Client is requested to remove any pool floats from the pool area and allow them to dry before the arrival of Brides and Baches. To minimize waste, the Client is requested to return any reusable items such as table confetti, unused straws, napkins, decorations, and any other applicable items to Brides and Baches.
X. MISSING OR DAMAGED ITEMS A. The Client shall be held financially responsible for replacing any missing or damaged rental items listed on the invoice or for paying the replacement cost of such items. Therefore, it is strongly advised that the Client handle all rental items with utmost care.
XI. SUBSTITUTIONS A. In rare circumstances, Brides and Baches may need to substitute certain elements of the decorating package due to unavailability. However, the Client will be informed in advance of any such substitutions, and their approval will be obtained before proceeding with the substitute elements.
XII. THIRD-PARTY SERVICE PROVIDERS A. Brides and Baches may provide referrals to third-party service providers or make bookings on behalf of the client (“The Client”), such as Private Chefs, Cabana Boys, Airbnb, and others. However, it is understood and acknowledged that Brides and Baches shall not be held liable for any issues that may arise from the client’s engagement with these third-party service providers. By agreeing to this Service Agreement, the client releases Brides and Baches, including its subsidiaries, affiliates, directors, officers, employees, agents, volunteers, and representatives, from any and all claims, causes of action, suits, demands, settlements, judgments, and expenses related to or arising from the referral made by Brides and Baches. The client assumes all risks associated with third-party house rentals that include a pool or spa located on the premises.

XIV. WARRANTY A. The services provided by Brides and Baches are offered on an “as-is” basis without any express, implied, or statutory warranties or representations, including but not limited to warranties of quality, performance, or fitness for a particular purpose in connection with the services rendered.
XV. LIMITATION OF LIABILITY A. By using Brides and Baches services, you accept all risks, both foreseeable and unforeseeable, arising from such transactions. Brides and Baches shall not be liable for any incidental, direct, indirect, negligent, exemplary, consequential, statutory, punitive, or special damages, whether based on breach of contract, tort, strict liability, or any other legal theory, even if advised of the possibility of such damages or if such damages could have been reasonably foreseen. The use of these services is solely at your discretion and risk.
XVI. COVID GUIDELINES A. Brides and Baches retains the authority to require clients and their respective groups to adhere to all safety guidelines to ensure compliance with COVID safety protocols within mandated jurisdictions. In the event of a positive COVID diagnosis, clients must wait for a minimum of 5 days after the initial manifestation of symptoms before using our services and interacting with our personnel. Clients should also wear masks for the following 5 days.
XVII. SEVERABILITY A. If any clause or provision of this Agreement is deemed invalid by a court of competent jurisdiction, the remaining provisions of this Agreement shall remain valid and enforceable. The parties direct the court to modify or revise this Agreement to give effect to the intention of the parties to the fullest extent permitted by law, thereby reducing or eliminating the liability of Brides and Baches.
XVIII. CHOICE OF LAW; VENUE A. This Service Agreement shall be governed, interpreted, and enforced in accordance with the laws of the State of Arizona. In the event of any dispute concerning the interpretation or construction of any provision of this Agreement, the venue for such action shall be in the courts of the State of Arizona, located in the County of Maricopa.
